I.PERSONAL DATA PROCESSING AND PROTECTION CHARTER

Introduction

In order to provide you with the highest level of quality and security, we want to give you oversight of the data collected on UBIX and how that data is used. Since its inception, UBIX has always taken care to protect data. We have never sent spam or used data for any purpose other than improving our service. Our primary commitment is to comply with applicable data protection legislation, in particular the General Data Protection Regulation (also known as GDPR), and the French Data Protection Act ("Loi Informatique et Libertés") of 6 January 1978, as amended.

The UBIX software is a trademark of UBITIK, which therefore owns it.

Data collected and purposes

We undertake to collect only the data we need to provide an optimal UBIX service, to ensure its confidentiality and security, and to make it easier for you to exercise your rights over your data. Data used, processed, hosted, backed up or stored by UBIX on behalf of the Partner remains the property of the Partner or its clients. Access to the data is reserved for the Partner and its clients. However, the Partner is informed of, and accepts, that UBITIK also accesses this data solely for the purposes of carrying out its mission and improving the quality of its services.

Recipients

UBIX is the recipient of data collected. We only share your personal data with trusted service providers when necessary, and solely in such cases, so that they can process it on our behalf, in accordance with our instructions or a contractual agreement, in compliance with this Charter and with all other appropriate security and confidentiality measures. As such, we use STRIPE (which carries out secure online payments on our behalf when licences are purchased), Google LLC (Google Analytics, for statistical purposes), the Rocket Science Group LLC (MailChimp for sending our communications), and lastly OVH and AWS for data storage.

Important: UBIX does not resell the data, information or documents you entrust to us, and we do not disclose personal or private information outside of the situations described in this Privacy Policy.

Retention period

UBIX retains your information unless you request its deletion or the deletion of your account, with the exception of your billing details, which are retained for 10 years from the closure of your account in order to comply with our accounting and tax obligations.

Data security

We implement appropriate technical and organisational measures to guarantee the ongoing security, confidentiality, integrity, availability and resilience of the UBIX service.

We undertake to use all available means to ensure the security and confidentiality of this data, in particular: we encrypt our services using SSL technology, we verify your email address when your account is created.

Access to personal data is strictly limited to UBITIK employees and service providers who need to access it in order to process it on our behalf. These individuals are subject to strict confidentiality obligations and may face disciplinary sanctions, including dismissal, in the event of a breach of these obligations.

Rights

In accordance with the provisions of the French Act known as the "Data Protection Act" of 6 January 1978, as amended, and the General Data Protection Regulation, you have the right of access, rectification, erasure, restriction, objection, and portability of your personal data.

These rights may be exercised directly on the Site, in the "contact" section. For security reasons and to prevent fraudulent requests, such requests must be accompanied by proof of identity.

Cookies

For the Site and Services to function properly, cookies are placed on your computer when you connect to the Site. Cookies are small text files stored in your browser or on your device by websites, applications, online media and adverts. However, you may object to the use of cookies by configuring your browser settings. As each browser is different, please refer to your browser's help section to configure it as you wish.

Storage volume limit

UBIX limits storage capacity per client account to a reasonable level of use. The limit is set at 3 gigabytes per project. This storage volume may be extended as part of an offer made when the amount of data hosted on the account reaches the contractual limit.

II.DATA PROTECTION LAWS

Our files have been declared to the CNIL under number 1984164v0. In accordance with the French "Data Protection Act" no. 78-17 of 6 January 1978, users have the right to object to, access, modify, rectify and delete personal information concerning them.
